The Ex-Chairman of Adavi Local Government Area of Kogi state and two time commissioner , Mr. Jimoh Enesi has been sentenced to 6 months imprisonment for Money laundering by federal High sitting lokoja .
Delivering his judgement yesterday at the Federal High Court in Lokoja in 16 counts charge brought against the ex-council boss,the trail judge, Justice Inyang Ekwo sentenced him over the misappropriation of N7 million contract money.
On other counts charge of Forgery and perjury being emphasised by the EFCC legal Counsel, Justice Ekwo pointed out the that onus of proof lies on prosecution to prove beyond the reasonable,but failed to call the former Commissioner and permanent secretary in Ministry of Local government and Chieftaincy Affairs who purportedly signed the letter as witness to give evidence.
He noted that the prosecution only relied on the statement of the Commissioner and permanent secretary who was not admissible in law,adding that this amount hearsay in the eye of law.
Justice Ekwo noted that Mr. Jimoh Enesi was convict for misappropriation of N7 million of Borehole contract in 10 wards of council, adding that he claimed to have awarded N8 million for the contract and only N1million to the contractor and admitted that he could not account for N7 million during the trial.
Meanwhile, the ex-chairman of Adavi local government and former commissioner for Youths, Sport and Agriculture sport in the state, Mr. Jimoh Enesi will be cooling off in prison pending the
process of appeal in appellate court.
The legal counsel to the accused person, Mr. Humphrey Olu Agunbiade told journalists that the defence will appeal the judgement.
